La Cour doit se montrer intransigeant envers les prédateurs sexuels qui sévissent sur les enfants. Ainsi, dans un jugement rendu la semaine dernière, un père, qui avait 52 ans lorsqu’il a abusé sexuellement sa fille de 6 ans, aura à purger une peine d’emprisonnement de 8 ans. Le père est aujourd’hui âgé de 61 ans.
Justice a été rendue même si 11 ans après, la fille n’a toujours pas pu surmonter ces moments douloureux de sa vie. Son père aura à payer pour ses actions. L’homme de loi de l’agresseur avait plaidé pour une amende mais la juge B. Sawock a considéré que l’homme a failli à son devoir de père. ‘ A father-daughter relationship is undoubtedly the most beautiful relationship in the world. There is a very special bond that a daughter shares with her father. It is a relationship of friendship, unconditional love and complete trust. Fathers are those who only have the welfare of their daughters at heart. A daughter no matter how old she grows, always remain her father’s little girl whom the fathercontinues to protect’, est écrit dans le jugement.
Pour la Cour, la fille était la benjamine dans une famille qui comprenait quatre enfants et il était du devoir de son père de le protéger davantage. Il a au contraire abusé de cette confiance dans sa propre maison, ce qui est encore plus révoltante. Il y a, selon la juge une double violation vu que la maison doit être… ‘a sanctuary where a child should feel safe and secure, a placewhere a child can sleep peacefully, oblivious of arll dangers of the world,knowing that her parents are there to protect her.But instead of being a place of safety, the family home becamethe location of abuse.Instead of being a haven, it became a place to fear.’
La Cour a donc un devoir de montrer à la population que ces actes ne doivent être tolérées et les amendements apportés aux différentes loi pour assurer la protection des enfants sont des indications que le législateur a voulu durcir la loi, assurer davantage la protection des enfants et punir les criminelles. Pas question de traiteurs ces prédateurs avec compassion. ‘This court has repeatedly warned that child abusers, who have themselves not been compassionate towards their victims, will not be treated with compassion. After fully bearing in mind, on the one hand, that sentencing is not a crushing exercise and, on the other hand, the obligation to protect the most vulnerable members of society,the need to deter others,the grave public concern and revulsionaroused by this type of offence and the importance of maintaining public confidence in the sentencing system, I order the accused to undergo 8 years penal servitude’
